The Judicial Service Commission (JSC) was founded in 1977 under Article 112 (1) of the Constitution of the United Republic of Tanzania, as amended by Chapter 237 of the Judicial Management Act. Prior to the enactment of the Judicial Service Act No. 2 of 2005, and now the Judicial Management Act, Chapter 237, there were two Commissions that dealt with Court personnel: the Judicial Service Commission, which dealt with Resident Magistrates and District Magistrates, and the Special Judicial Service Commission, which dealt with Primary Court judges. Currently, the Judicial Service Commission handles employment and disciplinary problems for judicial personnel.

The Constitution of the United Republic of Tanzania and the Judicial Management Act, Chapter 237, specify the Commission’s members and responsibilities. In order to carry out its responsibility of supervising the ethics of judicial officers, the Commission has delegated authority to Ethics Committees at various levels. These committees are responsible for evaluating complaints against judges, magistrates, and non-judicial officers and submitting reports to the Commission for determination.
