The Job Purpose:
The Legal Officer (Litigation) will oversee and manage all litigation proceedings impacting the organization. This includes devising litigation strategy, ensuring legal compliance, overseeing external counsel, and representing the company in courts, tribunals, and other conflict resolution forums.
The Principle Responsibilities:
Litigation Management:
Represent the organization in legal actions, such as court, arbitration, mediation, and tribunals. Prepare, review, and submit pleadings, affidavits, petitions, applications, and other court documents. Maintain correct litigation records and provide timely updates to stakeholders.
The Legal Strategies and Risk Assessment:
Create and implement litigation plans to safeguard the organization’s interests. Conduct legal risk assessments and provide advice on potential liabilities in litigation concerns. Provide legal advice and recommendations to senior management.
Coordinate with External Counsel:
Liaise with external legal counsel and law firms that represent the Bank. Monitor performance and provide any appropriate feedback to external counsel. Ensure cost-effective lawsuit management and budgetary compliance.
The Compliance and advisory:
Make sure that all litigation matters conform with applicable laws and regulations. Advise internal teams on litigation risks and preventive measures to reduce exposure. Help to create and review legal policies and procedures.
The Research and documentation:
To conduct legal research on case law, statutes, and regulations that are pertinent to current or anticipated litigation. Keep a complete database of precedents, legal documents, and case histories.
The Dispute Resolution:
To participate in alternative conflict resolution techniques to help resolve disputes amicably. Negotiate settlements where appropriate to reduce litigation risks and expenses.
The Stakeholder Communication:
Act as a liaison between internal stakeholders and the legal team on all litigation-related issues. Prepare and provide reports to management on the status and outcome of litigation.
The required Qualifications:
- A bachelor’s degree in law (LL.B.) from a recognized university or institution.
- A Master’s Degree will give you an advantage.
- Admitted as a High Court Advocate.
- A minimum of three (3) years of work experience.
- Excellent grasp of all legal aspects relating to the Bank’s operations.
- Excellent speaking and communication skills in both English and Swahili.
- The ability to adapt and work cooperatively and effectively.
- Problem-solving requires both creative and analytical thinking.
- A strong litigation skills.
- A strong relationship-building and diplomatic interpersonal abilities, as well as an awareness of the emotional, attitudinal, and political sides of business life.
- The excellent negotiating and communication skills.
- The excellent decision-making ability.
- Be prepared to work long hours.
